Request a protection certificate for a new plant variety

About the Service

Through this service, a new plant variety protection approved after conducting a virtual examination and a technical examination of a new plant variety protection request, and ensuring that it meets the requirements of protecting new plant varieties in accordance with Federal Law No. (17) Regarding the protection of new plant varieties of 2009.

Service Process

  1. Fill out the electronic form
  2. Conduct a formal examination of the application
  3. Conduct technical examination of the application
  4. Issuing a decision by the Registrar granting the right of plant varieties from the date of the technical examination and Published in the Official Gazette
  5. In case there is no objection to the application the certificate will issue electronically

Required Documents

  • Approval that the customer know all the requirements stipulated in the Ministerial decree and to bear all responsibility if that the data received is incorrect.
  • Original “power of attorney” when submitting the application for registration for non- plant breeder
  • A statement proving that the variety is new and is distinct from other types of plants of the same type.
  • A statement proving that no modification or development or change in its genetic makeup.
  • A statement proving that the variety does not harm the health of humans, animals and plants
  • A statement that the variety has no impact on the sustainability and use of biodiversity and the environment in general.
  • A statement confirming the stability of the variety and the number of propagation cycle that the special characteristics of variety does not change during it. And the changes observed during propagation, replication, reproduction, and the percentage of mixing observed or expected to occur.

  • A statement that the new variety has not been commercially exploited for one year in the country or for 4 years outside the country in accordance to the ministerial decree No. 17 of 2009 and its executive regulations.

 

Conditions & Requirements

  • Applications submitted to the Ministry must comply with all the above-mentioned documents
  • Registration requests and documents submitted in Arabic, and if they submitted in any other language, a legal translation in Arabic attached to it, and all documents submitted are true copies and certified by the competent authorities and certified by the country's embassies abroad
  • All data and documents required by the Ministry must be completed within (30) days of submitting the application, to avoid its cancellation.
  • Priority should be given to applications submitted first in order and date of submission.
